Agents Representative Course
Description
This qualification reflects the role of individuals who want to be an employee of a licensed estate agent who performs any of an estate agent’s functions ‑ for example, a salesperson or property manager ‑ under the authority of that agent. An agent’s representative cannot operate a real estate business.
Requirements
You Must:
- be at least 18 years old
- meet the educational requirements prescribed by the Estate Agents (Education) Regulations 2008. That is, you must either have completed a prescribed course:
- within the last five years, or
- at any time and held an estate agent’s licence or worked as an agent’s representative within the last 10 years.
You Must Not:
- have been found guilty of any offence involving fraud, dishonesty, drug trafficking or violence punishable by three months or more imprisonment (whether or not a jail term was imposed), within the last 10 years
- be an insolvent under administration. This means:
- a person who is an undischarged bankrupt, or
- a person who has executed a deed of arrangement under Part X of the Bankruptcy Act 1966, or
- a person whose creditors have accepted a composition under Part X of the Bankruptcy Act 1966, or
- a person who has made a debt agreement under Part IX of the Bankruptcy Act 1966.
- be the cause of a successful claim against the Victorian Property Fund or a corresponding fund
- be a represented person under the Guardianship and Administration Act 1986
- be subject to a Victorian Civil and Administrative Tribunal declaration making you ineligible to act as an agent’s representative
- be subject to an order by any regulatory body in or outside Victoria, disqualifying you from acting as an agent’s representative.
Educational Requirements
To be employed as an agent’s representative, you must have completed the following three units of competency from the CPP07 Property Services training package::
- CPPDSM4080A – Work in the real estate industry
- CPPDSM4008A – Identify legal and ethical requirements of property sales to complete agency work
- CPPDSM4007A – Identify legal and ethical requirements of property management to complete agency work
or one of the previously available courses:
- Course in Property (Agents’ Representatives)
- Course in Real Estate for Agents’ Representatives
- Course in Sub-agency Practice
- Sub-agent’s Preliminary Education Course
- the six prescribed modules of the Certificate in Real Estate Operations.
or one of the following courses:
- Certificate IV in Property Services (Real Estate)
- Certificate IV in Property (Real Estate Agency Practice)
- Certificate IV in Business (Estate Agency Practice)
- Bachelor of Business Property (Agency & Marketing stream)
- Advanced Certificate in Estate Agency
- Advanced Certificate in Real Estate
- Certificate in Business Studies (Real Estate)
- Estate Agency Certificate
- the 16 prescribed units of the Certificate of Business Studies (Real Estate) started before 1 January 1987.
Starting Work
Before you can start work as an agent’s representative, your employer must:
- check you meet the above eligibility requirements
- give you written authority to act on his or her behalf.
When you start, you must give your employer a:
- Statement of Attainment showing you hold the required educational qualifications
- completed Declaration of eligibility to be employed as an agent’s representative (Word, 599KB)
- police check. A form for obtaining this check is available from the Victoria Police website. If your police check is more than six months old, you must also provide a statutory declaration that you have not been found guilty of a disqualifying criminal offence. You must provide your employer with a new police check within six weeks of starting work; otherwise, you will become ineligible to continue to be employed.
Ceasing Employment and Re-Employment
It is in your interest to make sure your employer advises the Business Licensing Authority when you start or cease employment as an agent’s representative, so the public register contains the correct employment details.
Each time you seek re-employment as an agent’s representative your new employer must separately verify that you meet all the eligibility criteria.
To notify the Business Licensing Authority, complete and lodge the
Estate agents – add or cease agent’s representative employment online form.
Permission
You must apply for permission to work as an agent’s representative or continue to work as one if you:
- have been convicted or found guilty of any offence involving fraud, dishonesty, drug trafficking or violence punishable by three months or more imprisonment (whether or not a jail sentence was imposed), within the last 10 years
- are an insolvent under administration
- are the cause of a successful claim against the Victorian Property Fund or a corresponding fund.
If you become ineligible as a result of any of the above, you may continue to work in the role, pending the Business Licensing Authority’s decision, if you apply for permission within 30 days of the above occurring.
